These Terms of Service (“Terms”, “Agreement”) govern your access to and use of influencersBazaar.com (“Platform”, “Website”, “Service”), operated by Technobug IT Solutions Pvt. Ltd. (trading as Anic Digital), registered at 3rd Floor, Silicon Towers, Kondapur, Hyderabad – 500032, Telangana, India (CIN: U72900MH2021PTC369218).

By registering, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Platform.

1. Definitions

  • “Platform” refers to influencersBazaar.com website and all associated services
  • “Brand” refers to a registered user seeking influencer marketing services
  • “Creator” / “Influencer” refers to a registered content creator listed on the marketplace
  • “Order” refers to a service engagement placed by a Brand for a Creator’s services
  • “Campaign” refers to an influencer marketing project managed through the Platform
  • “Admin” / “We” refers to influencersBazaar / Anic Digital

2. Eligibility

  • You must be at least 18 years old to use this Platform
  • If registering on behalf of a company or organization, you must have authority to bind that entity to these Terms
  • You must provide accurate, current, and complete registration information
  • You are responsible for maintaining the confidentiality of your account credentials

3. Platform Overview & Business Model

influencersBazaar operates as a managed marketplace connecting brands with content creators/influencers. Key aspects of our model:

  • We act as an intermediary facilitating the connection between Brands and Creators
  • All orders, communications, and payments flow through the Platform
  • Direct contact between Brands and Creators outside the Platform for orders placed through influencersBazaar is prohibited
  • Pricing displayed to Brands includes our service fee/margin
  • Creator payouts are processed by the Admin after successful campaign delivery

4. User Accounts

4.1 Registration

  • You must create an account to access certain features (placing orders, managing campaigns, dashboard access)
  • You agree to provide truthful, accurate, and up-to-date information during registration
  • You are responsible for all activities under your account
  • Sharing your account credentials with third parties is prohibited

4.2 Account Termination

  • You may deactivate your account at any time by contacting support
  • We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice
  • Upon termination, your right to use the Platform ceases immediately
  • Outstanding payment obligations survive account termination

5. Creator Terms

  • Creators must provide accurate profile information including social media handles, follower counts, and category
  • Creators agree to have their profiles displayed publicly on the marketplace
  • Creators must deliver content within the agreed turnaround time (TAT)
  • Content must be original and must not infringe any third-party intellectual property rights
  • Creators must not engage in follower fraud, engagement manipulation, or any form of metric inflation
  • Creator payouts are subject to successful order completion and Brand satisfaction
  • influencersBazaar reserves the right to verify creator metrics and remove profiles with inflated or fraudulent data

6. Brand Terms

  • Brands must provide accurate company/brand information during registration
  • Brands must provide clear campaign briefs and content guidelines when placing orders
  • Payment must be made at the time of order placement or within the specified payment window
  • Brands must provide timely feedback and approvals on delivered content
  • Brands must not use the Platform to find creators and then contact them directly to circumvent our services
  • Campaign content must comply with all applicable advertising regulations and guidelines (ASCI guidelines in India)

7. Orders & Payments

7.1 Order Process

  • Orders are placed through the Platform by selecting a Creator and specifying campaign requirements
  • All orders are subject to acceptance by the Admin/Platform
  • Prices displayed include platform service fees and are in Indian Rupees (INR)
  • GST (18%) is applicable on all services as per Indian tax laws

7.2 Payment Terms

  • Payments are processed securely through Razorpay
  • Accepted payment methods include: UPI, Credit/Debit Cards, Net Banking, Wallets
  • Payment must be completed to confirm an order
  • All payments are subject to verification and fraud checks

7.3 Creator Payments

  • Creator payouts are made after successful delivery and order completion
  • Payout amounts are as agreed between the Creator and the Platform
  • Payouts are processed via bank transfer/UPI within 7-15 business days of order completion
  • Creators are responsible for their own tax obligations

8. Intellectual Property

  • The Platform, its design, logos, graphics, code, and content are the intellectual property of Technobug IT Solutions Pvt. Ltd.
  • Content created by Creators for Brand campaigns — usage rights are as specified in the individual order/campaign brief
  • You may not copy, reproduce, distribute, or create derivative works from Platform content without written permission
  • Brands grant us a limited license to display their brand name and logo for marketplace and promotional purposes
  • Creators grant us a limited license to display their profile data, social media handles, and sample content for marketplace listing purposes

9. Prohibited Conduct

Users must not:

  • Use the Platform for any unlawful purpose or in violation of any applicable laws
  • Provide false, misleading, or inaccurate information
  • Circumvent the Platform to engage in direct transactions with users discovered through the Platform
  • Scrape, crawl, or use automated tools to access or collect data from the Platform
  • Upload content that is defamatory, obscene, offensive, or violates the rights of any third party
  • Attempt to gain unauthorized access to other accounts, systems, or networks
  • Engage in any activity that could damage, disable, or impair the Platform
  • Use fake followers, bots, or engagement manipulation services
  • Spam other users with unsolicited communications

10. Limitation of Liability

  • The Platform is provided on an “as is” and “as available” basis
  • We do not guarantee the accuracy of Creator metrics, follower counts, or engagement rates
  • We are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Platform
  • We do not guarantee campaign results, performance metrics, or return on investment
  • Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim
  • We are not responsible for the quality, accuracy, or timeliness of content delivered by Creators
  • We are not liable for disputes between Brands and Creators, though we will make reasonable efforts to mediate

11. Indemnification

You agree to indemnify, defend, and hold harmless influencersBazaar, Anic Digital, Technobug IT Solutions Pvt. Ltd., its directors, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of or access to the Platform
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you submit or share through the Platform
  • Your violation of any applicable law or regulation

12. Dispute Resolution

  • Any disputes arising from these Terms shall first be attempted to be resolved through mutual negotiation
  • If negotiation fails, disputes shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996
  • The seat of arbitration shall be Hyderabad, Telangana, India
  • The language of arbitration shall be English
  • These Terms shall be governed by and construed in accordance with the laws of India
  • The courts of Hyderabad, Telangana shall have exclusive jurisdiction

13. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Platform after modifications constitutes acceptance of the revised Terms. For material changes, we may notify you via email or a notice on the Platform.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, along with our Privacy Policy, Refund Policy, and Disclaimer, constitute the entire agreement between you and influencersBazaar regarding the use of the Platform.
